Lasting Powers of Attorney

Lasting Powers of Attorney allow you to choose who you wish to be responsible for your financial, property and business affairs (Property and Financial Affairs LPA) and your health and personal welfare (Health and Welfare LPA) at a point in the future when either you are no longer able to take responsibility yourself (due to mental or physical incapacity).

Property and Financial Affairs LPA

A Property and Financial Affairs LPA gives your Attorney(s) the right to make decisions concerning your financial assets which can include decisions about your home, dealing with savings and investments, running your bank account, paying your bills and running any business interests you may have.

Health and Welfare LPA

A Health and Welfare LPA can only be used in the event that you have lost mental capacity. This LPA allows your attorney(s) to make decisions about your personal welfare including decisions about where you should live, your day-to-day care and giving consent to or arranging for medical treatment.

We prepare the necessary documentation for you to create an LPA for either Property and Financial Affairs or Health and Welfare or both. Both types of LPA must be registered with the Office of the Public Guardian before they can be used.

We advise on legal capacity issues and all issues relating to the Court of Protection and Enduring Powers of Attorney created under the old system.

Our fees are as follows:

  • Single Power of Attorney (financial or health) – £450.00 plus VAT.
    If several Attorneys need to be contacted – £500.00 plus VAT.
  • Single Power of Attorney for two people (one each) – £650.00 plus VAT.
    If several Attorneys need to be contacted – £750.00 plus VAT
  • Both Powers of Attorney for two people – £1,000.00 plus VAT.
    Where a Solicitor needs to act as certificate provider, where there are additional letters to Attorneys required or the addition of clauses relating to preferences and instructions – £1,200.00 plus VAT.
